DO YOU ACCEPT FAX FILINGS?

Sutter County Court does not have a direct line for accepting fax filings. Please refer to Rule 2.303 for using the services of a fax filing agency to submit documents. Under Rule 2.303 there are provisions for using the services of a fax filing agency. Please check the yellow pages of the phone directory for services that may be available in Sutter County. As long as the provisions of Rule 2.303, Rules 2.100 – 2.119 and the appropriate filing fees are submitted, the Court will accept a fax filing. Each document filed by a fax filing agency shall contain the phrase “BY FAX” immediately below the title of the document


HOW DO I SET LAW AND MOTION HEARINGS?
Civil, probate and conservatorship matters are set on Mondays at 9:00 am in Department B. If a Monday is a holiday, the hearings are moved to Tuesday. Family law and guardianship matters are set on Mondays at 9:00 am in Department A. If a Monday is a holiday, the hearings are not moved to Tuesday but set the following week.

It is not necessary to call and reserve a date; you may choose any Monday that allows enough time for appropriate service. You need only to submit your motion or order to show cause with the appropriate filing fee or application for waiver of court fees and costs.


HOW DO I OBTAIN A CONTINUANCE OR NOTIFY THE COURT OF SETTLEMENT?
Requests for continuances of law and motion matters or case management conferences shall be made by written stipulation of the parties or counsel or by oral agreement of the parties with the requesting party filing and paying the appropriate fees, before the date and time for the hearing, written notification with proof of service to the opposing party or counsel.

Requests for continuance of court and/or jury trials must be submitted by motion with proper service and payment of the appropriate fees.
Parties should contact the court to advise the case has settled and to drop any hearings from calendar and then follow up with the mandatory judicial counsel for Notice of Settlement.


DO YOU ALLOW TELEPHONIC APPEARANCES?
The Court permits telephonic appearances at the hearings listed in California Rules of Court 3.670(c) (rev. 7/1/10) and arranged through CourtCall. It is required by this Court and without exception, that an appearance must be prearranged no later than three (3) days before the hearing.


HOW DO I ARRANGE EX PARTE HEARINGS?

Civil, Probate and Conservatorship ex parte hearings are heard in Department B at 3:00 pm Monday through Thursday. Family law and Guardianship ex parte hearings are heard in Department A on a case-by-case basis. Prior arrangements must be made with the civil clerk and, pursuant to Rule 3.1203, a party seeking an exparte hearing must notify all parties no later than 10:00 am the court day before the appearance, absent a showing of exceptional circumstances. There is a filing fee for the ex parte hearing and another filing fee for a motion or order to show cause that requires a hearing.


DO YOU HAVE TENTATIVE RULINGS FOR MOTIONS OR ORDERS TO SHOW CAUSE?
Sutter County does not have tentative rulings, and appearances are necessary for law and motion hearings.

HOW DO I MAKE A REQUEST FOR ACCOMMODATIONS BY PERSONS WITH
DISABILITIES PURSUANT TO RULE 989.3?
It is the policy of the courts of this state to assure that qualified individuals with disabilities have equal and full access to the judicial system. Nothing in this rule shall be construed to impose limitations or to invalidate the remedies, rights, and procedures accorded to any qualified individuals with disabilities under state or federal law. Applications may be presented in writing or orally as the court may allow. The Request for Accommodations by Persons with Disabilities and Order may be presented in no less that five court days prior to the implementation date.
